Terms and Conditions
These terms and condition set out the basis upon which we, BMW India Private Limited, carrying out displaying and auctioning of available BMW Vehicles and therefore apply to all potential bidders of available BMW Vehicles. By submitting the bid the potential bidder hereby agreeing and accepting to these Terms & Conditions. It is important to recognize that in making a bid, this may result in potential bidder becoming liable to purchase the bid BMW Vehicle and may only be withdrawn after BMW India consent
Terms and conditions :
- The auction of BMW vehicles will be held on each car basis. The bid will be confirmed in favour of the person quoting the highest bid amount.
- BMW Vehicle details, list of documents with respect to the vehicle etc. will be available for inspection on the completion of bidding process.
- The potential bidders have right to inspect the BMW Car regarding its colour, conditions, registration details and other statutory documents before submitting the bid. BMW vehicle will be sold at “as is where is” basis. It is clarified test drive will not be available at the display venue.
- BMW India reserves the right :-
a. to refuse a bid without any reason.
b. to bid as agent for any prospective buyer.
c. to decide the name of the winner of a bid and sale price. BMW’s decision in this regard shall be final and binding.
d. to cancel a bid in case it believes that bid rigging has taken place.
e. to cancel the bidding process.
- An email confirmation will be sent to the winner of the bid/ successful bidder soon after a bid is approved by BMW India. Car will be invoiced through the authorized dealer of BMW India only from the respective location.
- The successful bidder will make a deposit at the authorized BMW dealer. The 10% of approved bid price (Advance Payment) as partial payment of the price of the vehicle within two days and balance payment in subsequent three days from the date of confirmation sent by BMW India. Non-adherence to the timely payment as stated above would automatically result in to cancellation of the bid.
- Successful bidder should submit Photo ID proof and Address proof and PAN card copy and other required details to qualify for purchase of BMW Car.
- In the event of a successful bidder neglecting or failing to comply with any of the conditions of sale within stipulated time, BMW India reserves the right to forfeit the Advance Payment. The vehicle thereafter may be re-sold by whichever means BMW India deem fit.
- The defaulting successful bidder shall indemnify BMW India for any loss or damage sustained as a result of such a resale.
- Participation in the bidding process shall be an acceptance by the bidder of the condition of the Vehicle as presented at the time of auction. Any claim will not be entertained and the bidder will have no right to reject the sale after the bidding process is completed and the winner is decided. BMW India shall not be liable for any claim from the bidder in this regard.
- The Vehicle for display/inspection is available at Hyderabad/Mumbai/Chennai and delivery will be arranged through authorized dealer subject to completion of necessary documents.
- The final bid price is inclusive of GST only. All other statutory levies, registration fees and transfer fees, insurance shall be solely borne by successful bidder. Registration of the Vehicle shall be the responsibility of the winner of the bid.
- BMW India shall not be liable for any act of omission or commission undertaken between the Dealer and the Customer in this regard.
- Transportation or any other incidental charges will be borne by the success bidder. BMW India shall not be liable for any indirect, punitive, special, incidental or consequential damages arising out or in connection with the bid. BMW India shall not be liable for any loss or damage arising due to force majeure event. No cash payment. Payment only through proper banking channels.
- By participating in online auction process, bidder accepts and agrees to above terms and conditions and also gives his unconditional consent for being contacted for the Vehicle over his telephone/mobile phone/email/sms. Non-acceptance of any of these terms and conditions will result in disqualification.
- The bidder’s contact details will be shared with BMW India and/or its Group Companies for purpose of monitoring and conducting surveys to improve quality of services. The bidder hereby gives his/her consent for such data sharing and also has no objection whatsoever for such data sharing.
- BMW India has the right to alter, modify or withdraw the bid anytime without any liability. In the case of disputes courts of New Delhi shall have exclusive jurisdiction.
